1. Introduction and Definitions

This document sets out the Terms and Conditions (hereinafter, the “Terms“) governing the use of the NEVAN website (the “Site“) and any purchase or use of products offered by NEVAN Rafał Łapiński, a business registered in Poland with its registered office at Władysława Korotyńskiego 40/18, 02-123 Warsaw, Poland (Tax Identification Number NIP: 8461574737), hereinafter referred to as “NEVAN” or the “Company“. In these Terms, the words “Customer“, “Client“, or “you” refer to any person or entity using the Site or purchasing products from NEVAN. By accessing the Site or requesting a quote/purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must refrain from using the Site or engaging in any transactions with NEVAN.

2. Information on the Website – No Commercial Offer

All information presented on the NEVAN Site, including product descriptions, images, and any indicated prices or price ranges, is provided for general informational purposes only. Such content does not constitute a binding offer or a commercial offer by NEVAN within the meaning of applicable contract lawstheclimb.pl. Instead, any product listing or price shown should be understood as an invitation for the Customer to request a quotation or to negotiate. NEVAN reserves the right to modify or withdraw any product information or pricing displayed on the Site at any time without prior notice. While NEVAN strives to ensure that all website content (including product specifications, dimensions, and pricing) is accurate and up-to-date, errors, inaccuracies, or omissions may occur. NEVAN will make every reasonable effort to correct any errors in the information once discovered, but shall not be legally bound by obvious errors or mistakes in website content. Product images on the Site are for illustrative purposes and may differ slightly from the actual product delivered (e.g. due to lighting or minor design updates).

In particular, prices displayed on the Site (including any “starting from” or range figures) are subject to change and are not binding on NEVAN until a formal quote is issued or a contract of sale is concluded. These prices typically exclude taxes, shipping costs, customs duties or other applicable charges, unless expressly stated otherwise. NEVAN reserves the right to change the prices of products, introduce new products, or discontinue products without notice. If a Customer has inquired about a product and during the quote preparation the price or availability changes, NEVAN will inform the Customer of such change and offer an updated quote before any contract is formedtheclimb.pl.

3. Quotations and Orders

Because NEVAN’s camper conversion kits are modular and often made-to-order to fit specific van models or customer requirements, the Company operates on the basis of individually prepared quotations rather than an instant online checkout. The ordering process is as follows:

• Requesting a Quote: Customers interested in purchasing a NEVAN DIY camper conversion kit should contact NEVAN (for example, via the Contact form, email, or other instructions on the Site) to discuss their needs. You may be asked to provide information about your van model, desired kit configuration, material options, shipping destination, and any custom preferences. NEVAN will then prepare a personalized quotation detailing the specific product components, price, estimated production time, and shipping costs for your requested configuration. Each quote is tailored to the individual Customer’s specifications and needs, and no two quotes may be exactly alike.

• Non-Binding Nature of Quotes: A quotation provided by NEVAN to a Customer is not an automatic acceptance of an order, but an offer to sell under the terms stated in the quote. Quotes are typically valid only for a limited period (e.g. 30 days) as stated on the quote, due to possible changes in material costs or other factors. NEVAN reserves the right to reject or revise a quote prior to acceptance if circumstances change (for example, if a supplier price increases or an error is discovered in the quote details). The quote will outline the price, inclusions (what is in the kit), exclusions (anything not included), expected production lead time, and delivery terms.

• Placing an Order (Accepting the Quote): If you receive a quote and wish to proceed with the purchase, you must communicate your acceptance of the quote to NEVAN in the manner instructed (such as signing the quote, replying with written acceptance via email, or clicking acceptance through an online system if available). Only upon NEVAN’s confirmation of your acceptance (which may be accompanied by an invoice or payment request) will a binding Sales Agreement come into existence. NEVAN will then proceed to fulfill the order as per the agreed terms. NEVAN may require full or partial payment upfront (as specified in the quote) before production begins. NEVAN is not obliged to supply any product until a Sales Agreement is formed and any required pre-payment is received.

• Direct Website Orders (if applicable): In the event that the Site temporarily allows adding items to a cart or placing an “order” through an online form, such orders shall be treated as requests for a quote or purchase. NEVAN’s team will review any orders placed online, and the order will only be confirmed (becoming a binding contract) once NEVAN expressly accepts it (for example, by confirming the order via email or commencing production after payment). NEVAN reserves the right to contact the Customer to clarify any details, or to refuse/cancel an order (with a refund of any payment made) if the information on the Site was inaccurate or if there are other legitimate reasons (such as inability to ship to the provided address, etc.).

Note: By submitting a quote request or order, you warrant that all information you provide (including vehicle details and contact information) is accurate and complete. NEVAN will not be responsible for delays or issues arising from incorrect information provided by the Customer.

4. Pricing and Payment Terms

All prices communicated by NEVAN (whether on the Site or in an individual quote) are in Euro (€) unless stated otherwise. Prices are net of any applicable taxes (e.g. VAT) and shipping costs, which will be specified in the quote or order invoice where applicable. If you are located in a different country, additional taxes or import duties may apply (see Section 6 on Shipping). NEVAN will typically provide a breakdown of the price, including the product cost and estimated shipping fees, in the quote or invoice.

Payment Methods: NEVAN accepts payment via bank transfer and may accept other payment methods such as credit/debit cards or online payment services (the available options will be communicated to you with the invoice or on the Site’s payment page). All payments must be made in the currency stated on the invoice (generally Euros) and must be received in full into NEVAN’s designated account before the order is processed. The Customer is responsible for any bank transfer fees or charges. For card payments or electronic payments, the transaction is subject to authorization by the payment provider.

Timing of Payment: Because products are made to order, NEVAN generally requires payment before production commences. The quote or invoice will specify the required payment terms – for example, NEVAN may require a full upfront payment or a deposit (such as 50%) at the time of order confirmation, with the balance due before shipment. The order lead time (production period) of approximately 3 weeks will commence only after NEVAN has confirmed receipt of the required paymentnevankit.com. If the Customer fails to pay any amount due by the specified deadline, NEVAN reserves the right to delay production/shipment or to cancel the order entirely (in which case any partial payments may be refunded minus reasonable costs incurred, if any).

Ownership Retention: Ownership (title) of any goods sold will remain with NEVAN until the purchase price and any applicable charges are paid in full by the Customer. Only after full payment is received does ownership of the product transfer to the Customer. NEVAN shall, however, bear the risk of loss or damage to the product until delivery to the Customer (see Section 6 on Delivery and Risk).

NEVAN reserves the right to correct any pricing errors that were not detected before issuing an invoice or accepting an order. If a pricing error is discovered, NEVAN will notify the Customer as soon as possible with the corrected price. The Customer may then choose to proceed with the order at the correct price or cancel the order. In the event of cancellation due to a pricing error, any amounts already paid will be refunded to the Customer.

5. Intellectual Property and Confidentiality

All content on the NEVAN Site – including but not limited to text, descriptions, product designs, images, graphics, logos, videos, and downloadable materials – is protected by intellectual property laws and is owned by or licensed to NEVAN. This includes the design and concept of the modular DIY camper conversion kits themselves, as well as any technical drawings, plans, or documentation provided to customers. NEVAN reserves all rights in its intellectual property.

By using the Site or engaging with NEVAN, you agree not to violate NEVAN’s intellectual property rights. In particular, unless you have NEVAN’s prior written consent, you are NOT permitted to:

• Copy, reproduce, republish, or redistribute any content from the Site for any commercial purpose. This means you cannot take NEVAN’s product descriptions, images, or other materials and use them on another website or in any marketing material. All data, descriptions, and images presented by NEVAN are the property of the Company and may not be copied or used for commercial purposes without permissiontheclimb.pl.

• Use or exploit NEVAN’s product designs or concepts to create derivative products. Purchasing a NEVAN kit grants you the right to use that kit in your own vehicle, but does not grant any license or rights to manufacture, duplicate or commercialize the design. Any attempt to reverse engineer the kit for the purpose of producing copies or to assist a third-party in making similar conversion kits would violate these Terms and NEVAN’s intellectual property rights.

• Infringe NEVAN’s trademarks or trade name. The name “NEVAN”, the NEVAN logo, and any other trademarks or service marks used by the Company are protected. You may not use NEVAN’s name or logos in any manner (for example, on a website or product of your own) that could confuse consumers or imply an association without NEVAN’s prior written approval.

If you submit any ideas, suggestions, or feedback to NEVAN (for example, improvements to products or new design ideas), you acknowledge that NEVAN may use such feedback freely and you will not claim intellectual property rights or compensation for such use.

Protection of Idea and Designs: NEVAN values its innovative modular design concepts. Any drawings, specifications, or other technical information provided to the Customer during the quote or installation process remain NEVAN’s confidential information and intellectual property. The Customer agrees not to disclose such information to any third party (except as necessary to install the product in their own vehicle) and not to use it for any purpose other than installing and using NEVAN’s products. This obligation of confidentiality and non-use extends beyond the termination of the Customer’s relationship with NEVAN.

NEVAN will aggressively enforce its intellectual property rights to the fullest extent of the law. Any unauthorized use of content or infringement of NEVAN’s IP may result in civil and/or criminal penalties.

6. Production, Delivery and Shipping

Production Time: All NEVAN camper conversion kits are made to order. Upon receiving a confirmed order (and any required pre-payment), NEVAN will schedule production of your kit. Typical production lead time is approximately 3 weeks from payment confirmationnevankit.com. However, this lead time is an estimate and may vary based on current order volumes, supply of materials, or specific customizations. NEVAN will keep the Customer informed of the expected production and dispatch dates. We will notify you when production is complete and the item is ready to ship, providing an expected shipping or delivery date.

Shipping Regions: NEVAN currently offers international shipping primarily to countries within the European Union (EU) and to the United Kingdom (UK). If you are located outside these areas, please inquire separately – NEVAN may or may not be able to accommodate shipping to other regions on a case-by-case basis. We do not ship to P.O. boxes or third-party drop-shipping addresses that cannot be verified. A valid physical address where someone can accept delivery is required.

Shipping Costs: The cost of delivery will depend on the destination and the size/weight of the kit. As a reference, a minimum shipping fee is around €400 for certain regionsnevankit.com, but actual costs can be higher and will be provided to you in the quote or before finalizing your order. All shipping costs will be borne by the Customer unless otherwise explicitly agreed by NEVAN. The product prices shown on the Site do not include shipping feestheclimb.pl; those are added separately. Customers are responsible for any import duties, taxes, or customs fees that may apply for shipments to countries outside of Poland (this particularly applies to UK deliveries after Brexit). NEVAN has no control over such charges and cannot predict their amount; contact your local customs office for information on import duties. NEVAN is not liable for any delays at customs or additional fees due to import procedures.

Delivery Method and Timing: NEVAN will arrange shipment via reputable freight or courier services. Available delivery options (standard freight, express shipping, or personal pickup in special casesnevankit.com) will be discussed with you. Once your order is shipped, NEVAN will provide you with a tracking number or shipping information so you can monitor the progress of the deliverynevankit.com. Delivery times vary by destination; NEVAN will give an estimate (for example, 3-10 business days for shipping, depending on country). Please note that all delivery times are estimates and not guaranteed. While NEVAN strives to deliver within the indicated timeframe, delays can occur due to circumstances beyond our control, such as carrier delays, customs clearance, or logistical issues. NEVAN shall not be held liable for delays in transit. However, if NEVAN becomes aware of a significant delay, we will communicate updates to the Customer and work to resolve any issues within our control.

Customer Responsibilities on Delivery: It is the Customer’s responsibility to ensure that someone is available at the specified delivery address to receive the shipment. Upon delivery, inspect the package for any visible damage before signing the delivery receipt. If the packaging appears significantly damaged in transit, you may choose to refuse the shipment and immediately inform both the courier and NEVAN. In case of minor damage to packaging, accept the parcel but make sure the courier notes the damage on the delivery receipt, and take photographs of the condition. You must notify NEVAN of any transit damage or missing components within 24 hours of receiving the shipment (via email or phone), so that we can assist in rectifying the issue. Failure to report shipping damage timely may limit our ability to file claims with the carrier.

If delivery is attempted and you fail to accept it (for example, no one is present to sign for it on multiple attempts), the package may be returned to NEVAN or held by the carrier. In such case, any additional shipping or storage fees incurred may be charged to the Customer, and re-delivery will be arranged at the Customer’s expense. NEVAN will communicate with you to arrange a new delivery if this occurs. For safety, do not leave large shipments outdoors unattended for long periods after delivery.

Upon delivery, risk of loss or damage to the products passes to the Customer. This means once the kit is delivered and signed for, the Customer is responsible for its care and NEVAN is generally not liable for any loss or damage that occurs thereafter (subject to the warranty provisions for manufacturing defects in Section 7).

7. Products Made-to-Order – Returns and Cancellation Policy

NEVAN’s camper conversion kits are typically made to order or customized to the Customer’s vehicle model and preferences. Under EU consumer protection law, goods that are made to order or clearly personalized are exempt from the usual 14-day right of withdrawal (cooling-off period) that applies to standard online purchaseseuropa.eu. By placing an order with NEVAN, you acknowledge that once production of your custom kit has begun, you may not cancel the order and are not entitled to return the product for a refund simply due to a change of mind.

Order Cancellation: If you wish to cancel your order, you must contact NEVAN as soon as possible. If your cancellation request is received before NEVAN has accepted your order and begun production, NEVAN may agree to cancel and refund any payments made, minus any reasonable administrative or bank fees. However, once the order is confirmed and production has started (or materials have been specifically procured for your kit), cancellation is no longer possible without incurring costs. NEVAN, at its discretion, may allow a cancellation with a partial refund depending on how far along production is, but this is not guaranteed. Orders that are completed and/or shipped cannot be cancelled.

No Returns on Custom-Made Products: As the products are custom-made to your order, NEVAN does not offer returns or exchanges except in cases of defect or non-conformity (see below). This means that if the product you receive matches the specifications of your order and is free from manufacturing defects, it is considered a final sale. We urge Customers to consider their purchase carefully and ask any questions before placing the order. NEVAN provides detailed information and is available to clarify any doubts about compatibility or features prior to ordering.

Defective or Non-Conforming Products: NEVAN guarantees that the products will be delivered free from manufacturing defects and will conform to the specifications agreed in the quote/order. Upon receiving your kit, please carefully inspect all parts and components. If you discover a manufacturing defect (for example, a part was cut incorrectly not matching the provided measurements, or there is a structural flaw) or a non-conformity (for example, you received a different variant than ordered, or a component is missing), you must inform NEVAN within 7 days of delivery (or within a reasonable time upon discovery of a latent defect that was not apparent immediately). Notification should be sent to NEVAN’s contact email (such as info@nevankit.com) with a description of the issue and supporting photographs if possible.

Once you report a potential defect, NEVAN will work with you to investigate the issue. If the product is confirmed by NEVAN to be defective or not as advertised, NEVAN will, at its option: (a) provide replacement parts or a replacement product, (b) repair the defect (which may involve sending you a repair kit or arranging a fix), or (c) if a repair or replacement is not feasible, issue an appropriate refund or price reduction. The chosen remedy will depend on the nature of the defect and what is practical (NEVAN will try to ensure you can use your camper kit as intended). Any return of defective products for repair/replacement will be arranged by NEVAN at no cost to the Customer (NEVAN will cover shipping in case of confirmed defects). However, the Customer may be asked to adequately package the item for return shipping to prevent damage in transit.

Condition of Return: If a return of a defective product is authorized, the item must be returned in as close to the delivered condition as possible. The Customer should not continue to use a product they believe is defective, as this could worsen the damage or make it harder to discern the original defect. Do not attempt to modify or repair a defective item yourself without NEVAN’s guidance, as this may void your warranty (see Section 8).

Situations Not Eligible for Return/Replacement: NEVAN’s warranty for defects does not cover issues that arise from: (i) normal wear and tear, (ii) misuse, abuse, or improper installation of the product by the Customer (see Section 8 regarding installation responsibility), (iii) accidents or external events after delivery, or (iv) alterations or custom modifications made by the Customer. Additionally, minor variations in color, grain, or finish of natural materials (like wood) are not considered defects but natural characteristics of the product. Such minor aesthetic variations or expected deviations will not be a basis for return if they do not affect functionality.

In summary, returns are only accepted in case of genuine product defects or NEVAN’s error in fulfilling your order. Due to the bespoke nature of NEVAN kits, no returns or refunds will be given for change of mind or ordering mistakes once production has beguneuropa.eu. This policy does not affect any statutory rights you may have under law for defective products; it primarily clarifies the absence of a general “cooling-off” return right for custom goods.

8. Warranty and Disclaimer of Warranties

NEVAN stands by the quality of its products. We provide a warranty against manufacturing defects in materials and workmanship for a period of [specify duration, e.g., one (1) year] from the date of delivery. This means that if within the warranty period you discover a defect in your NEVAN camper conversion kit that is attributable to poor workmanship or faulty materials (and not due to misuse or improper installation), NEVAN will repair or replace the defective component at no charge, as described in Section 7. This warranty is provided to the original purchaser only and is non-transferable.

To claim a warranty service, the Customer should contact NEVAN with proof of purchase and details of the issue. NEVAN may require photographs or other evidence, and in some cases may need the item returned for inspection. If a returned product is found not to be defective (for example, the issue was due to incorrect installation by the user or is within normal tolerances), NEVAN reserves the right to return the product to the Customer and decline warranty service, or to charge the Customer for the cost of shipping and any inspection fees incurred. NEVAN will communicate and explain the determination in such cases.

Disclaimer of Other Warranties: To the maximum extent permitted by law, NEVAN disclaims all other warranties, guarantees or conditions, whether express or implied, relating to the products and services provided. In particular, NEVAN does not make any promise that the products will meet all of the Customer’s expectations beyond the specifications, or that they will be fit for a particular purpose not expressly disclosed to NEVAN. (If you have a specific intended use beyond normal camper van conversion, it is your responsibility to ensure the product is suitable.) NEVAN also disclaims any implied warranties of merchantability or fitness for a general purpose, except where such disclaimers are prohibited by law.

It is important to note that NEVAN’s kits require proper assembly and installation. NEVAN provides instructions and guidance, but the ultimate success of the installation depends on the Customer’s diligence and adherence to the guidelines. NEVAN does not warrant that assembly by the Customer will be error-free or that the finished conversion will meet any official vehicle standards or regulations in your jurisdiction (the kits are for DIY use – it is up to the vehicle owner to ensure compliance with any roadworthiness or safety regulations).

If any third-party components or appliances (such as fridges, stoves, or batteries) are suggested or linked on our Site, those items are not covered by NEVAN’s warranty and may be subject to their own manufacturers’ warranties. NEVAN’s liability covers only the kit components we manufacture or supply.

9. Limitation of Liability

Use at Your Own Risk: The NEVAN modular conversion kits are designed for DIY installation by the Customer. While the kit is engineered for ease of assembly and includes instructions, NEVAN is not responsible for the manner in which you install or use the kit. By purchasing and installing a NEVAN kit, you acknowledge that you (or any person installing or using the kit) are doing so at your own risk. NEVAN accepts no liability for any damage, injury, or losses arising from improper installation or improper use of the products. This includes, without limitation, any damage to your vehicle, other property, or personal injuries that occur due to incorrect assembly, unsecured fixtures, overloading, or any use that is not in accordance with NEVAN’s instructions and guidelines. If you are in doubt about how to safely install any component, it is your responsibility to consult a qualified professional installer. NEVAN’s kits often contain heavy or moving parts; they should be installed and operated by adults, and any use by or near children must be supervised.

Exclusion of Certain Damages: To the fullest extent permitted by applicable law, NEVAN will not be liable to the Customer or any user of the products for any indirect, incidental, special, consequential, or punitive damages. This exclusion includes, for example, any loss of profit, loss of revenue, loss of business opportunity, or loss of data, and also covers damages to other property or equipment (such as any ancillary devices you install in the van) or costs of third-party repairs. NEVAN shall not be liable for any diminution in the value of your vehicle resulting from modifications or installation of the kit. Moreover, NEVAN is not liable for any losses arising from events beyond its control, including delays in delivery (as noted), acts of God, accidents during shipment, or regulatory changes that impact the use of camper conversions.

Limitation of Amount: In any event, to the extent that NEVAN is found liable for any claim arising out of or related to these Terms or the use of NEVAN products (whether in contract, tort, or otherwise), NEVAN’s total aggregate liability shall be limited to the amount actually paid by the Customer to NEVAN for the specific product or service that gave rise to the liability. For example, if you purchased a kit for €3,000, NEVAN’s maximum liability for all claims related to that kit will not exceed €3,000. This limitation is cumulative and not per incident.

No Liability for Website Use: Separately, with regard to use of the Site itself (independent of any product purchase), NEVAN does not guarantee that the Site will be available at all times or free from errors (technical or typographical). The Site and its content are provided on an “as is” basis. To the extent permitted by law, NEVAN will not be liable for any loss or damage arising from your use of or inability to use the Site, or from reliance on any information on the Site that may be outdated or incorrect. It is the user’s responsibility to verify critical information by contacting NEVAN directly.

Exceptions: Nothing in these Terms seeks to limit or exclude NEVAN’s liability in areas where the law does not allow such exclusion or limitation. In particular, NEVAN does not limit its liability for: (a) death or personal injury caused by NEVAN’s proven negligence or willful misconduct, (b) fraud or fraudulent misrepresentation, or (c) any other liability which cannot be excluded under applicable law. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability for certain types of damages, so some of the above exclusions may not apply to you. In such cases, any legally required warranty or liability will be limited to the shortest duration or minimum scope permitted by law.

10. Miscellaneous Provisions

• Governing Law: These Terms and any disputes arising out of or relating to them or the use of NEVAN products or services shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles. However, if you are a consumer residing in another country, you may also have certain rights under the mandatory consumer protection laws of your country of residence, and nothing in these Terms will deprive you of those protections. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to transactions under these Terms.

• Jurisdiction: Any dispute or claim arising between NEVAN and a Customer that cannot be resolved amicably shall be subject to the jurisdiction of the competent courts of Poland, unless applicable law requires that such disputes be resolved in the Customer’s home jurisdiction (for example, certain consumer dispute rules in the EU or UK). NEVAN will in good faith attempt to resolve any concerns or disputes through negotiation before resorting to legal action. Customers are encouraged to contact NEVAN to discuss any issue; we value customer satisfaction and may be able to find a solution without formal proceedings.

• Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if that is not possible, it shall be severed (removed) from these Terms. All other provisions of the Terms will remain in full force and effect. NEVAN’s failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

• Amendments to Terms: NEVAN reserves the right to update or modify these Terms from time to time. Any new version of the Terms will be posted on the Site with an updated effective date. It is your responsibility to review the Terms periodically. If you have a current Sales Agreement (order in progress), the terms that were in effect at the time of your order will generally apply to that transaction. Continued use of the Site or further purchases from NEVAN after any changes to the Terms have been posted constitutes acceptance of those changes.

• Entire Agreement: These Terms, together with any agreed quote or invoice terms for a specific order, and any policies referenced herein (such as our Privacy Policy, which governs the handling of personal data), constitute the entire agreement between the Customer and NEVAN regarding the subject matter. They supersede any prior agreements, understandings, or representations, whether oral or written, relating to the same subject.

• Intellectual Property of Third Parties: Any third-party trademarks or materials appearing on the Site (for example, names of van models or appliances) remain the property of their respective owners. NEVAN’s reference to them is only to indicate compatibility or suggestions and does not imply any affiliation with or endorsement by those third parties.
